In short, it means an overbooking or overbooking that occurs in the field of passenger transport by air.<\/p>\n\n\n\n<p>But beyond the literal translation, <strong>overbooking consists of <\/strong>in the ability of airlines to accept a higher volume of bookings than the number of seats available for a flight.<\/p>\n\n\n\n<p>In this sense, a commercial airline can estimate an overbooking percentage based on the passengers it estimates will cancel their tickets before the flight and those who will not show up.<\/p>\n\n\n\n<p>This power is legally recognised in the <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=DOUE-L-2004-80291\" target=\"_blank\" rel=\"noreferrer noopener\">Regulation (EC) No 261\/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295\/91.<\/a><\/p>\n\n\n\n<p>However, it may happen that at check-in and boarding there are more reservations than the number of seats available on the flight.<\/p>\n\n\n\n<p>In this case, the airline has two alternatives:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Ask passengers to volunteer to desist from the flight in exchange for compensation and benefits.<\/li><li>And if there are no volunteers, the airline will draw lots to determine which passengers are denied boarding due to overbooking.<\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><a><\/a>Passenger rights<\/h1>\n\n\n\n<p>When overbooking occurs, you must be forewarned and, although you may think that this denial of boarding due to overbooking is illegal, the truth is that it is not.<\/p>\n\n\n\n<p>However, you have the right:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Be informed about your rights<\/li><li>Be looked after while waiting for your return or alternative flight (food, drink, two phone calls or access to email, hotel accommodation if an overnight stay is necessary and transport between the airport and the place of accommodation).<\/li><li>Claim reimbursement - within 7 days - or alternative transport to your destination.<\/li><li>Claiming financial compensation<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"512\" src=\"https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/10\/overbooking-en-malaga-1024x512.jpg\" alt=\"overbooking in malaga\" class=\"wp-image-2374\" srcset=\"https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/10\/overbooking-en-malaga-1024x512.jpg 1024w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/10\/overbooking-en-malaga-300x150.jpg 300w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/10\/overbooking-en-malaga-768x384.jpg 768w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/10\/overbooking-en-malaga-1536x768.jpg 1536w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/10\/overbooking-en-malaga-2048x1024.jpg 2048w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/10\/overbooking-en-malaga-18x9.jpg 18w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">So... What do I do if I have been denied boarding due to overbooking?<\/h2>\n\n\n\n<p>If you are unlucky enough to be overbooked, first of all: don't lose your temper.
