{"id":2422,"date":"2022-11-08T11:16:47","date_gmt":"2022-11-08T10:16:47","guid":{"rendered":"https:\/\/odiceabogados.com\/?p=2422"},"modified":"2023-07-24T07:57:08","modified_gmt":"2023-07-24T06:57:08","slug":"4-motivos-para-impugnar-un-testamento-en-espana","status":"publish","type":"post","link":"https:\/\/odiceabogados.com\/en\/4-reasons-for-challenging-a-testament-in-spain\/","title":{"rendered":"4 grounds for contesting a will in Spain\u00a0"},"content":{"rendered":"<h2 class=\"wp-block-heading\">What is the purpose of contesting a will?<\/h2>\n\n\n\n<p>If you disagree with the contents of the will and the cause is legally justified, both you and any of the other co-heirs, <strong>you can make use of one of the grounds for contesting a will.<\/strong><\/p>\n\n\n\n<p>In general, this situation occurs when events such as disinheritance of a family member, unequal distribution of the inheritance or when the testator has acted under pressure from third parties.<\/p>\n\n\n\n<p>However, below we will look in detail at the 4 most common grounds for successfully contesting a will in Spain.<\/p>\n\n\n\n<div style=\"height:22px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Grounds for contesting a will <\/h2>\n\n\n\n<div style=\"height:22px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Challenging a will due to the absence of a compulsory heir in the will<\/h3>\n\n\n\n<p>When there is no mention of a compulsory heir in a will we talk about <strong>preterition<\/strong>.&nbsp;<\/p>\n\n\n\n<p>The lack of naming can be intentional or unintentional. In the first case, it occurs when the testator knows of the existence of the heir but does not name him\/her in the will. The second occurs when the testator is unaware of the existence of the heir, for example: not knowing that the testator has a child.<\/p>\n\n\n\n<p>Whatever the cause of the heir's absence, the heir may contest the will.<\/p>\n\n\n\n<div style=\"height:22px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Challenging a will on the grounds of incapacity of the testator<\/h3>\n\n\n\n<p>The Spanish Civil Code includes two situations within this cause:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>When the testator at the time of making the will is unable to conform or express his will even with the help of means or aids to do so.<\/li>\n\n\n\n<li>When the testator is<strong> under 14 years of age<\/strong>.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:48px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"512\" src=\"https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/11\/imagenes-blog-odice-1024x512.png\" alt=\"grounds for contesting a will in Spain\" class=\"wp-image-2423\" srcset=\"https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/11\/imagenes-blog-odice-1024x512.png 1024w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/11\/imagenes-blog-odice-300x150.png 300w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/11\/imagenes-blog-odice-768x384.png 768w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/11\/imagenes-blog-odice-1536x768.png 1536w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/11\/imagenes-blog-odice-2048x1024.png 2048w, https:\/\/odiceabogados.com\/wp-content\/uploads\/2022\/11\/imagenes-blog-odice-18x9.png 18w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<div style=\"height:48px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Challenging a will on the grounds of non-compliance with the law on the distribution of assets<\/h3>\n\n\n\n<p>We must bear in mind that inheritance is divided into three parts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>One-third of the reserved portion of inheritance <\/strong>(<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1889-4763\" target=\"_blank\" rel=\"noreferrer noopener\">Article 806 of the Civil Code<\/a>): divided equally among the legitimated heirs.<\/li>\n\n\n\n<li><strong>Hereditary improvement third<\/strong>The testator may voluntarily dispose of one of the thirds to improve the inheritance of one or more of the children or descendants.<\/li>\n\n\n\n<li><strong>Unrestricted third<\/strong>The testator distributes the inheritance according to his will to the person of his choice without this person being a descendant or relative (forced heir).<\/li>\n<\/ul>\n\n\n\n<p>On this basis, if, for whatever reason, this distribution is not complied with, the heirs have the right to contest the will on the grounds that <strong>the testator may not deprive the forced heirs of their reserved portion.<\/strong><\/p>\n\n\n\n<div style=\"height:22px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Challenging a will on the grounds of formal errors in the drafting of the will<\/h3>\n\n\n\n<p>As we discussed in our<strong> <\/strong><a href=\"https:\/\/odiceabogados.com\/en\/testamento-extranjero-en-espana\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>article on wills in Spain<\/strong><\/a><strong>,<\/strong> There are different types of wills, among which we will highlight the most common ones: open, closed or holographic.<\/p>\n\n\n\n<p>Each of them has its own requirements, the non-fulfilment of which may give rise to grounds for challenge.
